Regulations of the online shop pickappbox.pl

The owner and operator of the Internet shop operating under the address ppickappbox.pl is Darco Sp. z o.o. (Limited Liability Company) with its registered office in Dębica (address: Metalowców 43, 39-200 Dębica), NIP 8722177114, REGON 691758322, registered in the Register of Entrepreneurs of the National Court Register by the District Court in Rzeszów, XII Economic Department of the National Court Register under the KRS number 0000170668, with the share capital of PLN 800,000.

§1 Definitions

1.Customer – a natural person, a legal person or an organizational unit that is not a legal person but to which special regulations grant legal capacity, who makes an Order from the Online Store; 

2. Consumer – a natural person who makes a legal transaction with the Seller which is not directly connected with his/her economic or professional activity;

3. User – means a Customer who has registered on the website of the Shop;

4. Terms and Conditions – this set of rules and regulations governing sales in the Online Store and the provision of electronic services in the Online Store.

5. Online Store/Store – the online shop operated by the Seller and available at pickappbox.pl .

6. Seller – Darco Sp. z o.o. (Limited Liability Company) with its registered office in Dębica (address:  Metalowców 43, 39-200 Dębica), NIP 8722177114, REGON 691758322, registered in the Register of Entrepreneurs of the National Court Register by the District Court in Rzeszów, XII Economic Department of the National Court Register under the KRS number 0000170668, with the initial capital of 800 000 PLN;

7. Contract of sale – a distance contract of sale (of Products available in the Store) concluded between the Seller and the Customer, on the principles set out in the Terms and Conditions;

8. Working days – days of the week from Monday to Friday, excluding public holidays, from 7:00 a.m. to 3:00 p.m;

9. Product – the products presented on the Store’s website;

10. Order – Customer’s declaration of will, aiming directly at the conclusion of a Sales Agreement, specifying in particular the type, number of goods, method of payment, method of delivery.

§2 General provisions

(1) These Terms and Conditions set out the rules for the use of the online shop, placing orders for products available in the online shop, delivery of ordered products to customers, payment by customers, the customer’s right to withdraw from the contract and the rules for handling complaints.

4. Hotline number of the shop: Poland 14 680 99 79. The indicated telephone number of the Shop’s Hotline is open on Business Days (the fee is the same as for an ordinary telephone call, according to the tariff package of the service provider used by the Customer).

5. The Shop’s Customer Service is available to Shoppers only on Business Days from 7:00 a.m. to 3:00 p.m.

6. The Seller reserves the right to carry out maintenance work on the ICT system, which may cause difficulties or prevent customers from using the services. 

7. The technical requirements for the proper operation of ICT system used by the Store are: Internet connection, web browser, active e-mail account.

§3 Registration and login

1. The Customer shall automatically register with the Store free of charge by creating an individual account for the Customer. For this purpose, the Customer fills in a registration form available on the Store’s website. Purchases can also be made without registration. 

2. After submitting a completed registration form, the Customer will immediately receive an e-mail notification of successful registration. 

3. Upon registration, an individual account is created for the Customer, who obtains the status of a User.

4. The individual account contains the Customer’s data provided by the Customer in the registration form and the history of purchases made in the Online Shop.

5. Customer registration in the Store is optional. The Customer may place an Order without registering, after reading and accepting these Terms and Conditions and agreeing to the processing of the Customer’s data by the Seller for the purpose of fulfilling the Order.

6. In order to place an Order without registration, the Customer is required to fill in a form that appears after adding products to the basket. 

7. The condition of registration and purchase in the Store is to provide true personal data indicated in the relevant registration form and acceptance by the Customer of the provisions of the Terms and Conditions by checking the appropriate box before finalizing the Order.

8. After registration, the User may log into the Store at any time using the data provided during registration.

9. The user who has his/her own account in the Store, after logging in, can freely modify his/her data provided during registration, as well as view the history of orders and payments.

10. The Customer declares that the data provided in the registration form and when placing an Order without registration are true and do not violate the rights of third parties.

§4 Placing orders

1. In order to conclude a sales contract through the Store, an Order must be placed in accordance with the instructions on the Store’s website.

2. The Customer may place an order via the Store’s website 24 hours a day, 7 days a week.

3. The Customer begins the process of ordering the Products available in the Store by adding them to the “Basket”.

4. Once the Customer has filled in all the required fields, a summary of the Order placed will be displayed containing a description of the selected Products and their price and delivery costs.

5. The Customer will be able to choose one of the payment methods available on the Store’s website.

6. In the event that the Customer violates any of the provisions of the Terms and Conditions, in particular in the event of failure to provide the data necessary to process the Order, the Order shall not be processed.

7. At any stage of the Order placement process, until payment is made, the Order may be cancelled by discontinuing the subsequent steps and exiting the sub-page through which the Order is placed. An Order which is not completed by the Customer shall not be processed. 

8. The conclusion of the Sales Agreement shall occur at the moment of confirmation of the Order by the Seller. Confirmation of the order placement takes place by the Seller immediately sending the Customer a relevant e-mail message to the Customer’s e-mail address provided during the order placement process.

9. After the Order has been placed, the Customer will also receive automatic e-mails to the e-mail address provided during the placement of the Order, informing that the Order has been accepted for processing and that the package with the Order has been dispatched.

10. The Seller may contact the Customer at the e-mail address provided by the Customer or by telephone at the telephone number provided by the Customer in order to clarify any doubts regarding the Order placed or other issues related to the execution of the Order.

11. In exceptional situations, e.g. in the event that a given Product is out of stock or the Order cannot be fulfilled for any other reason, the Customer will be informed by e-mail or telephone about problems with the fulfilment of the Order and possible solutions.

§5 Product Prices

1. The prices of the Products displayed on the website of the Store include VAT and are given in Polish zloty (PLN). 

2. Prices of goods do not include delivery costs. Delivery costs will be indicated before placing an Order.

3. The binding and final price of the Products is the price displayed at the time of summarising the Order placed by the Customer.

4. Information on the price of the Product, the characteristics and essential features of the Product are available on the website of the Online Shop and are displayed next to the Product presented.

5. Each purchase made by the Customer is confirmed by a receipt or VAT invoice in accordance with the request indicated by the Customer.

6. The Seller reserves the right to change prices of Products in the Online Store, introduce new Products for sale, conduct and cancel promotional campaigns at the Online Store’s website, or make changes in accordance with applicable law.

§6 Shipping and payment

1. Goods are delivered exclusively in the Republic of Poland.

2. The delivery time of an order shall not exceed 7 working days, unless a different period is specified in the description of the Product or during the ordering process. In the event of temporary or permanent unavailability of the goods, the Customer will be immediately informed.  If the order consists of Products with different lead times, the order is sent to the Customer in accordance with the longest time limit in the order.

3. The Seller reserves the right to designate other Business Days on which Orders will not be fulfilled. 

4. An order made in the Shop may be paid as follows:

online transfer “PayU”

cash – payment on delivery (personal collection at the Seller’s cash desk) or directly to the courier delivering the consignment.

5. The order will be forwarded for dispatch after the conclusion of the contract of sale, whereby dispatch will only take place once payment for the Products has been credited. This does not apply if the Ordering Party has chosen to pay cash on delivery.

6. The ordered goods are delivered to the Customer by courier service to the address indicated by the Customer.

7. In the case of Personal Collection, the Customer will be informed by telephone or e-mail of the possibility and date of collection. The goods can be collected during the opening hours of the Seller’s Logistics Centre.

8. The Customer is obliged to check the delivered parcel in the presence of the courier. In the event of any damage or defect in the parcel, the Customer has the right to demand that an employee of the supplier writes a proper protocol.

9. Delivery costs and detailed terms of payment are available in the “Delivery” and “Payment”. 

10. The cost of shipping is also indicated when placing an order.

§7 Terms and conditions of withdrawal from the contract

1. The Customer, who is a Consumer, may withdraw from the contract of sale of the Product purchased in the Online Store without giving any reason by submitting an appropriate statement within 14 days.  

2. The period of withdrawal shall expire after 14 days from the day on which the Customer came into possession of the ordered Product or on which a third person other than the carrier and indicated by the Customer came into possession of the ordered Product.

3. In order to exercise the right of withdrawal, it is sufficient to inform the Seller of his decision to withdraw from the Sales Agreement by sending him a written statement of withdrawal (by mail to the address of the Seller) or by e-mail to the address of the Shop.

4. The Consumer may formulate the statement on their own or use the model statement of withdrawal available on the website of the Shop, which will speed up the return service.

5. To meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information concerning the exercise of the Consumer’s right of withdrawal before the expiry of the deadline for withdrawal to kontak@pickappbox.pl.  

6. Return shipment of purchased products should take place immediately, no later than within 14 days from the date of submission of the declaration of withdrawal from the sales contract by the Consumer. The purchased Product should be returned to the Seller’s address.

7. Withdrawal from the Sales Agreement may also take place in such a way that the Consumer sends back the purchased product together with a completed withdrawal form available at the Shop website to the Seller’s address within 14 days of its receipt. It is sufficient to send it by registered mail within the aforementioned period to meet the deadline.

8. The returned Product should be returned in the same condition in which it was issued and cannot bear traces of use indicating its use beyond the necessary extent needed to ascertain the nature of the Product, its characteristics and functioning. In the case of using the Product in a manner exceeding this scope, the Consumer shall be liable for diminishing the value of the thing. 

9. The Consumer shall send back the returned products at their own expense.

10. The Seller shall immediately, but not later than within 14 days from the date on which the Seller received the Products returned by the Consumer (subject to points 7 and 8 of this paragraph), return the payments made by the Consumer.

11. The Seller shall refund the payment using the same method of payment used by the Consumer, unless the Consumer agrees to a different method of refund, which method shall not involve any cost to the Consumer.

§8 Returns and Complaints

1. The subject of sale in the Online Shop are new Products without defects. In the case of a defect in the Product, the Seller shall be liable for the defects.

2. The Customer has the right to submit a complaint to the Online Store. Complaints are dealt with by the Seller.

3. Complaints can be submitted electronically via e-mail: kontakt@pickappbox.pl or by post to the address: Darco Sp. z o.o. with its registered office in Dębica (address:  Metalowców 43, 39-200 Dębica with the annotation; Complaint – Online Shop );

4. Correctly made complaint should include at least: name, surname, address, e-mail address of the Customer, number of the Order or number of the settlement document (receipt or invoice), description of the reason for the complaint, any circumstances justifying the complaint, the subject of the complaint, with an indication of the request of the Buyer.

5. If the data or information provided in the complaint need to be supplemented, the Seller, before considering the complaint, shall request the complainant to supplement it in the indicated scope.

6. The Seller shall consider the complaint within 14 days from the date of its receipt in a correct form. The response to the complaint is sent to the e-mail address provided by the Customer or to a postal address.

7. The Customer has the right to return the products purchased in the Online Store within 60 days from the date of purchase.

8. The Customer shall return the goods by completing the return form and sending it together with the returned Product to the following address: Darco Sp.z o.o.  with its registered office in Dębica (address: Metalowców 43, 39-200 Dębica with the annotation; Return – Online Shop ); 

The returned Product should be returned in its original packaging, in the same condition in which it was issued and cannot bear traces of use indicating its use beyond the necessary extent needed to ascertain the nature of the Product, its characteristics and functioning. In the case of using the Product in a manner exceeding this scope, the Consumer shall be responsible for diminishing the value of the thing. 

10. The Customer shall send back the returned products at their own expense.

11. The Seller shall immediately, but not later than within 14 days from the date on which the Customer made the return (subject to point 9 of this paragraph), return the payments made for the returned products.

12. The Seller shall refund the payment using the same method of payment used by the Customer, unless the Customer agrees to a different method of refund, and this method will not incur any cost for the Customer. 

13. The product which is not accepted for return will be sent back at the customer’s expense.

§9 Processing of personal data

1. The Seller is the administrator of personal data provided by Customers to the Seller in connection with registration, placing an Order in the Shop, using the help function and sending marketing information. 

2. The Seller processes the Customers’ personal data for the purpose of registration, Order processing and other purposes specified in the Terms and Conditions.

3. Collected personal data are not shared with third parties, except for the transfer of data to the entity participating in the implementation of the order for the purpose of delivering the ordered goods to the Customer. In the event that payment for the ordered Product is made in advance, the data is also transferred to the entity through which the transaction is settled. Personal data may be entrusted for processing to an Internet service provider providing server room resources to the personal data controller (hosting provider). The extent of data transferred is limited to the necessary minimum.

4 The Customer’s rights in relation to the provision of his/her personal data to the Seller are set out in the following Information Clause. In order to exercise these rights, the Customer should contact the Seller via e-mail: kontakt@pickappbox.pl or by post to: Darco sp.z o.o. its registered office in Dębica (address:  Metalowców 43, 39-200 Dębica);

5. In the event that the Customer has agreed to a service provided electronically, the subject of which is the free delivery of newsletters, the electronic mail address (e-mail address) obtained is added to an e-mailing list and is used for marketing purposes to send the Customer commercial information electronically in the form of a Newsletter.

6. Personal data shall be stored and protected against unauthorised access or use by unauthorised persons, as well as other cases of disclosure or loss and against destruction or unauthorised modification through the use of appropriate technical and organisational measures. 

The Seller uses cookies. 

§10 Final provisions

1. These Terms and Conditions are available at any time on the website of the Store.

2. All matters governed by these Terms and Conditions, including the conclusion of a contract of sale, its performance and termination, and legal relations relating to the use of the On-line shop are subject to Polish law. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Act of 23 April 1964 Civil Code (consolidated text Journal of Laws of 2017, item 459 as amended), and in the case of Customers who are Consumers, also the provisions of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2017, item 683).

3. The Seller reserves the right to amend these Terms and Conditions in the event of a change in the law affecting the rights and obligations under these Terms and Conditions or in order to improve the operation of the Online Shop, as well as to improve the protection of users’ rights and to prevent abuse.

4. The Seller reserves the right to amend these Terms and Conditions. All Orders accepted by the Seller for fulfilment before the date of entry into force of the new Terms and Conditions are fulfilled on the basis of the previous Terms and Conditions (which were in force at the time of concluding the sales contract). The amended Terms and Conditions come into effect within 14 days of their publication on the Store’s Website.

Information clause for customers of the online shop

Pursuant to Article 13 of the General Data Protection Regulation of 27 April 2016. (Official Journal of the EU L 119 of 04.05.2016), I inform you that:

1. The administrator of the Customer’s personal data is DARCO Sp. z o.o., address:  Metalowców 43, 39-200 Dębica

2. The Customer’s personal data will be processed for the purpose of order processing and after-sales service – on the basis of Art.6(1)(b) of the General Data Protection Regulation of 27 April 2016.

3. The provision of personal data is voluntary, however, the refusal to provide data may result in the refusal to process the order

4. The recipients of the Customer’s personal data will be entities participating in the processing of the order.

5. The Customer’s personal data will be stored for a period of 6 years

6. The Customer has the right to request access to personal data from the controller, the right to rectification, erasure or restriction of processing and the right to data portability

7. The Customer has the right to lodge a complaint to the supervisory authority
